General Terms and Conditions

1 Applicability

1.1 These general terms and conditions apply exclusively to all quotations, orders, and agreements concluded between the Orderer and LiesFen Concepts vof (trading as MrStarsky and hereinafter 'MrStarsky').

1.2 The Customer may only invoke deviating and/or supplementary clauses if and to the extent that these have been expressly accepted by MrStarsky.

1.3 The Customer with whom a contract has been concluded once on the basis of these terms and conditions accepts the applicability of these terms and conditions to subsequent agreements between him and MrStarsky.

2 Formation of the agreement

2.1 A purchase agreement is concluded between MrStarsky and the Customer at the moment the Customer accepts an offer from MrStarsky by fully and correctly completing the form made available by MrStarsky.

3 Prize

3.1 MrStarsky reserves the right to adjust the prices of its products. These adjusted prices will never apply to orders already placed by a Customer.

3.2 Promotions and offers are valid for the duration of the term and, where applicable, while stocks last.

3.3 The personal MrStarsky discount code is intended to recruit new Customers from one's own immediate circle (via word of mouth, social media, and/or email). MrStarsky discount codes may not be used for commercial purposes and/or purposes other than those for which they were issued. Furthermore, it is under no circumstances permitted to use the brand name MrStarsky and any possible combinations of incorrect spelling within URL combinations to attract traffic used to distribute the discount code.

3.4 Any (attempted) fraud or other unauthorized act will be recorded and will result in the denial of the use of discount codes. MrStarsky reserves the right to retroactively offset the obtained discount and accumulated credit.

4 Payment

4.1 For payment, the Customer may exclusively use the payment options offered by MrStarsky.

4.2 MrStarsky offers various payment methods, namely iDeal, BanContact, SofortBanking, and bank transfer.

4.3 If payment by bank transfer is chosen, MrStarsky will only process the order once the payment has been credited to MrStarsky's bank account. This means that delivery times as described on the MrStarsky website will only start running from the moment the payment has been credited to MrStarsky's bank account.

4.6 Invoices are provided by MrStarsky exclusively electronically.

5 Delivery, delivery time and execution

5.1 We deliver worldwide using the services of PostNL and PostNL's partners. However, our product range does not have worldwide coverage.

5.2 We charge a contribution towards shipping costs. The shipping costs are based on PostNL rates.

5.3 Our products will be delivered to the address specified by the Customer. The Customer may choose to have their order delivered to their own address or to the address of someone else.

5.4 The Consignor (i.e. the person to whom the consignment is sent) shall be the declarant and importer in the country for which the consignment is intended.

5.5 The indicative delivery times in the Netherlands stated by MrStarsky take into account the handling time of PostNL and its partners.

5.6 Orders do not require a signature upon receipt. This means that PostNL and its partners are permitted to deliver MrStarsky orders to neighbors, for example. For further information regarding delivery, we refer you to the websites of PostNL and its partners.

6 Withdrawal

6.1 When purchasing products, the Buyer has the option to withdraw from the agreement without giving reasons no later than 10:00 am CET following the time of ordering.

6.2 When purchasing products, the Customer has the option to submit changes to the information entered for the generation of a MrStarsky product before 10:00 am CET following the time of ordering.

6.3 Since MrStarsky products are customer-specific, they cannot be exchanged or returned.

6.4 If the order does not meet MrStarsky's quality requirements upon receipt, the Customer may contact us within 5 working days of receipt, stating the order number. Failure to meet MrStarsky's quality requirements includes damage incurred during transport or manufacturing defects. Failure to meet MrStarsky's quality requirements expressly does not include errors resulting from entering incorrect information when ordering a product.

7 Data protection

7.1 When handling an order, we process the personal data of the Customer. To inform the Customer about what happens to his or her data, we use a privacy statement.

8 Intellectual property

8.1 Copyright and other relevant intellectual property apply to all text, illustrations, photography, and everything else related to MrStarsky, MrStarsky's products, and this website.

8.2 No person is permitted to unlawfully reproduce the material mentioned in Article 8.1 or to bring it into the public domain in any other way without the prior permission of MrStarsky.

9 Warranty and liability

9.1 MrStarsky guarantees only that the products supplied by it are fit for the purpose for which they are intended pursuant to the information provided by MrStarsky and guarantees that the products comply with any statutory obligations and other government regulations applicable to that intended use.

9.2 MrStarsky guarantees that the products supplied by it are produced with respect for people and the environment, without the use of child labor.

10 Changes

10.1 MrStarsky reserves the right to amend these General Terms and Conditions at any time. It is recommended to consult these General Terms and Conditions regularly.

11 Disputes and applicable law

11.1 All obligations between MrStarsky and the Customer are governed by Dutch law.

11.2 The District Court of Amsterdam has exclusive jurisdiction to hear any disputes between MrStarsky and the Customer arising from or otherwise related to the agreement.
